Adoption attorneys or adoption law firms are best for prospective birth mothers who have already identified an adoptive family and who feel they don’t need much adoption counseling and support. It is important to carefully consider the resources and services you’d like to have available before choosing an adoption attorney as your adoption professional.
Throughout this process, remember that your adoption attorney is there to help, assist, and guide you. He or she should know of all your state’s adoption laws, rules, and regulations. Working with an adoption attorney is a great way to progress through the placement process because of the step-by-step and hands-on help that your adoption attorney should offer. Make use of the resources around you as you explore your options.
The law limits the amount of time a child may stay in foster care by establishing shorter timelines for determining when she or he must have a plan for permanency. The law states that permanency court hearings must be held for children no later than 12 months after they enter foster care and the law also states that termination of parental rights proceedings must begin for any child who has been in the care of a state agency for 15 out of the most recent 22 months. Exceptions may be made to this requirement if the child is in the care of a relative or for other compelling reasons.
Adopting a child or baby is a big decision, and it’s one that needs to be done right. Hiring a family lawyer that provides services in this sector of law can help give a person confidence they are doing everything right. For those who are thinking about hiring a lawyer for adoption in West Virginia, there are a few things they should consider. Being informed and knowing what this legal professional has to offer is the best way to know if they should be hired.
An adoption is a happy time in the life of the adopting family and in the life of the child being adopted. However, adoption is a complex and intricate area of family law. Adoption in Virginia is solely the product of statutory law and therefore compliance with all of the statutory requirements is a must to make the process proceed as seamlessly as possible. Adoptions can be stressful even at the best of times because of the legal hoops an adopting family must jump through even when an adoption is not contested. When there is conflict in an adoption, the stress levels can go through the roof. For these reasons, adoption is an area of law where it is almost always recommended that a skilled and experienced family attorney be involved.
Once all of these steps and reports are complete the court will evaluate all of the information provided in an effort to determine what is best for the child. The judge will make this decision after hearing the testimony of involved parties, examining the required reports and studies and then applying the law that applies to your particular situation.
An open adoption agreement spells out the terms of the contact between the parties in an open adoption. An open adoption agreement can specify frequency and manner of contact between adoptive and birth families, and/or between siblings placed separately. However, while it may be drawn up in the form of a contract and signed by both parties, it is not legally binding.
Adoption lawyers can help you find an adoption agency and file any necessary paperwork. They will also represent you in court if necessary. Lawyers will help you prepare for hearings if you need to state your case verbally in court. Some common problems include the birth parents trying to extort the adoptive parents or the birth parents change their minds. If there are any sort of legal complications, you’ll want to have an attorney on your side.

From your post, it sounds like you want to do a private adoption without the birthparents involvement. Unfortunately, it's not possible to go around the birthparents' rights. They have to be notified of your intention to adopt & you have to have their consent. And like I said, if you want to go the "I can't find them" route, it has to be an honest "I hired a private investigator and here is everything we've done" kind of situation. You have to convince a judge (who doesn't terminate parental rights on a whim) that you did everything humanly possible to contact that birthmom
You should expect to end the process with a child who is a legal member of your family. The entire adoption can take up to 5 years including waiting periods, but it’ll take less time depending on your case. If there are any legal complications or you don’t pass some of the qualifying examinations, the process could take longer. An adoption attorney can guide you through this and potentially expedite the process by knowing who to talk to and what paperwork to file.
